Agreement and Acceptance
“Personal Information” is information that specific to a User that helps to identify that User. To use Handzap Platform, Handzap requires that a User provide certain Personal Information, including the User’s name, address, photo, telephone number, email address.A User may choose to provide additional Personal Information to Handzap, including a list of the User’s contacts, access to documents and photos, access to the camera on the User’s device, and payment information (e.g., bank account and routing numbers, credit card number, tax information, and other payment information). A User may be required to provide such additional Personal Information if the User intends to use certain Handzap Platform features. “Location Information” is information derived from a User’s IP address or geolocation information provided by the User’s mobile telephone. To use Handzap Platform, Handzap requires that a User provide Location Information. Users may provide or Handzap may collect additional information that is neither Personal Information nor Location Information that Handzap may use as set out in the Policy. This includes information that Users may provide to Handzap or that Handzap may collect from a User when a User accesses Handzap Platform from a mobile device or links an Account to a social media account such as Facebook.
Information Use and Sharing
None of Users’ registration information shall be shared with other Users. When a Poster posts a Task and a Tasker reviews it or agrees to complete the Task, Handzap Platform will release information required to enable the Poster and Tasker to coordinate. This information may include Users’ full names, location, profile summary, portfolio, profile type, profile picture, people rating/reviews, among others. Handzap may use Users’ information for purposes including those related to:
- Transactional communications: Handzap may send text messages or place telephone calls to Users’ mobile telephones to improve Handzap Platform, provide reminders regarding Tasks, or for other reasons. Handzap shall not assess charges for text messages or telephone calls. Charges by Users’ wireless carriers may apply.
- Marketing communications: Handzap may reasonably seek to keep the User up to date on its pertinent products and services.
- Statistics: Handzap collects statistics about use of Handzap Platform. Aggregate statistics that do not personally identify an individual may be kept by Handzap and such aggregate statistics may be made available to Users or third parties.
- Reviews and testimonials: If a User provides feedback or testimonials, the User agrees that Handzap may use the User’s name in connection with Handzap’s publication and promotion of that feedback/testimonial.
Handzap Platform may store its information in AWS Cloud in some jurisdictions located around the world, to facilitate good service and responsiveness, subject to change from time to time, in accordance with technical requirements. E.U.-U.S. Privacy Shield
In Europe, Handzap Platform is hosted on AWS Cloud, which Handzap understands comply with the E.U.-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States.
Retention and Storage
Handzap shall retain Personal Information for a certain period of time it deems necessary to ensure that Handzap may act appropriately in any dispute, legal, User, or government request. Handzap may also retain Personal Information to assist a User in retrieving a lost password. Handzap may or may not permanently save conversations and transactional communications that Users conduct on Handzap Platform. Handzap may or may not save text messages on Handzap Platform. Regardless, Handzap expects that any such saved conversations, communications, or messages may be permanently deleted within a certain period of time, in accordance with technical requirements. Handzap may or may not delete multimedia communications, such as images, video, or audio message, immediately upon their delivery or rejection by a User. Users may use Handzap Platform email chat feature at their own risk to forward the text of their messages to a personal email address separate from Handzap Platform. Handzap shall not retrieve deleted communications between Users at the request of Users.
Rights to Content
Users grant Handzap a non-exclusive, worldwide, perpetual, freely transferable, irrevocable, royalty-free, sub-licensable rights to exercise all copyright, publicity rights, and any other rights in information that Users provide on Handzap Platform and information that Handzap collects from Users on Handzap Platform.
Disputes related to the Policy shall be governed by the same provisions set out in the Terms. Any dispute, controversy, claim, question, or disagreement arising out of or relating to the Agreement including any question regarding its existence, interpretation, validity, breach, or termination shall be referred to and finally resolved by arbitration as set out in the Terms.
WARNING: USERS SHOULD REVIEW THE TERMS OF SERVICE BEFORE USING HANDZAP PLATFORM TO ENSURE THAT THEY ARE PROCEEDING WITH THEIR USE OF HANDZAP PLATFORM ON AN INFORMED BASIS.
